Ask the County Law Librarian - Foreclosure Defense

Q: I just got a Notice of Default from my mortgage company. My friend told me I could stop the foreclosure process by demanding that the bank “produce the note.” What does this mean and will it really work? Thank you,  Louise A: The “produce the note” defense to foreclosure is touted by many on the Internet —people ask us for the forms needed to do that almost every day. The theory is that because loans are frequently transferred it may be difficult, if not impossible, for your mortgage company to trace the ultimate ownership of your specific loan. To foreclose, the lender must actually be current holder of the note, and a homeowner can delay foreclosure by filing a lawsuit demanding thi

City Council revisits 2003 contracts with Sacramento Kings

The City Council on Tuesday revisited the city’s 2003 loan agreements with the Sacramento Kings and decided to keep them in effect. City Treasurer Russ Fehr said he discovered the possible issue with the old loan agreement a few months ago. He said he discussed the matter with City Attorney Eileen Teichert, and she suggested that the current City Council examine the contract because it didn’t go before council members in 2003. "It's sad so much money is flying out there but it's not reaching small businesses, which are the engine that drives the economy," he said. Kyalwazi worked his way up the ladder at La Bou Bakery & Cafe. He started as a floor sweeper and, over 20 years, became

The project was led by Voyage’s Carly Harrington and Corinne Blackney, who quickly and efficiently brought the employees together and organized the donations in slightly over an hour’s time after hearing about The End’s efforts via the “Wake Up Call” morning show
