Ask Officer Michelle - Dealing with a Pesky Neighbor

Hello Officer Michelle,

My concern is about a neighbor across the street. I frequently see him outside on his driveway, drinking beer and playing loud music with friends. I’m not shy to ask them to lower the volume and most times they comply.

The issue I want to address is that they drive to the liquor store to get more alcohol when I know fully well that they have exceeded the legal alcohol limit based on the number of empty cans that strewn the driveway. Is this something I should report to the police? If so, how would I go about reporting a drunk driver if I do not know their location after they drive away from their home and when they return in only 15 minutes?

Currently, there are no laws or city codes that prohibit people from drinking alcohol outside on their own private property unless they are sitting in a vehicle, providing alcohol to minors, or venturing out onto the sidewalk or street. California Penal Code Section 647f deals with people who are intoxicated in public and basically states that anyone who is found in any public place under the influence of intoxicating liquor, or controlled substance in a condition that he or she is unable to exercise care for his or her own safety, or the safety of others, or by reason of his or her being under the influence interferes with or obstructs or prevents the free use of any street, sidewalk, or other public way is in violation of this code.

You can call us out on the noise complaint. It is a lower priority call, but we responded to these calls. We advise the party to turn down the music and give them a warning. If we have to return they can be cited for the noise complaint. If you suspect that your neighbor is intoxicated and driving, what you would want to do is to call 911, and tell the dispatcher what transpired, provide them with a physical description of the driver, and the vehicle, including the license plate number, and the last direction the vehicle traveled. This way they can broadcast the description out to units. The units in the area can check it out and stop the vehicle. It won’t hurt to call, and being called to these types of incidents is our job. You could save someone’s life. Statistics show that most vehicle accidents occur within three miles of your home. Couple that with alcohol, and it is a recipe for disaster. If this guy has done this in the past and continues to drive, it is only a matter of time before he hurts someone.

If the party in question is not breaking any law, then what justifys you being a nosey neighboor ?

is your owen life so free of responsibilites and projects that you have to play policeman to fill the void that is your existance?

get a life and mind your own bussniess... this is part of our societies downfall.

Thomas, if the person at the party is driving after consuming a good amount of beer, that person is most likely DUI, and that is breaking the law.

Loutish behavior is one thing, drunk driving is another. Perhaps if Thomas's kid was a victim of a 'beer run' he would be keener to 'play the policeman' - maybe not, maybe he'd just applaud the guy for getting on with his own life and not worrying about anybody else's - the good citizen that he is.

Hi Officer Michelle- I just signed up to Sac. press after reading your posts. I performed a google search because I am having major...I mean MAJOR issues with neighbors directly across the street. I just purchased my first home...which is both a stressful and joyous occassion in most peoples' lives! However, my home purchase is causing more stress than anyone should have to take.
I have only lived here a month and have had the rude awakening to the constant partying, playing pool at the pool table, drug dealing, gang-type hoodlums hanging out, etc. etc. on a daily basis weekdays and all day on weekends. I have called the non-emerg police a couple of times already to break up the bar scene after 10PM on weeknights, which they have complied too. I have reported the suspicious activity to your online site and also many code violations (besides the noise) to the city code enforcers. But the activity continues and right now, since 3PM today (Saturday), they have about 10 people out on the lawn and in the garage drinking 40oz. and partying. It's like living across from a constant bar/frat house/gang hangout and I'm already tired of it.
I wanted to see if I could get some help from you and maybe some of these other citizens. Obviously, I am worried about retaliation from these people and have talked to a couple of the other neighbors about it. They have basically given up on complaining and don't seem to know what else to do.
Again, this is my first house and unfortunately, the seller did not disclose her issues with these people to me. Otherwise, I would not have considered this place for a minute! But now I'm "locked in" so-to-speak! Please help! Any advice would be helpful!!
