Council reacts to investigation of Natomas building permits

A Sacramento city councilwoman said Sacramento’s municipal government has “gone wrong.” A second councilwoman blamed high-level city staff. And a councilman suggested that the city consider setting up a whistleblower hotline.

During an intense meeting Tuesday night, the Sacramento City Council grappled with an investigation involving the city’s community development department.

Council members wrestled with findings from an investigation into the department’s approval last year of 35 permits in a Natomas flood zone. The investigation was carried out by City Attorney Eileen Teichert’s office and a third-party law firm, Renee Sloan Holtzman Sakai.

In a recent report, the offices of the city attorney and city manager note that the department broke federal rules by approving the permits.

The report also points out several new issues with the building services division of the department. The issues include “potential quid pro quo,” “demolition without CEQA review,” “non-compliance with city’s planning requirements” and “non-compliance with fee-deferral program.”

The City Council unanimously decided Tuesday to move quickly to hire an external auditor to investigate the department.

“This council needs to find out what has gone wrong with city government, and we need to fix it,” Councilwoman Sandy Sheedy said.

Councilwoman Lauren Hammond blamed the department’s management.

“The problem is the management of the department,” she said.

Councilman Kevin McCarty raised the idea of a whisteblower hotline for the city.

Courtney McAlister, an attorney for K. Hovnanian Homes, the company that received the 35 permits, said there was no “quid pro quo” involving the company and the city. Assistant City Manager John Dangberg made the same comment.

I was hoping to read how Councilmember Rob Fong wrapped things up. I stayed as long as I could.... I didn't get to hear where he was going with the cross examination- lol. I also missed hearing Councilmember Pannel and Mayor Johnson since I had to leave.

Heck, Councilmember Fong missed his calling- I thought he sounded like a Prosecutor - and a darn good one. lol If I was on a jury I would have been impressed by him and voted to convict. BUT it wasn't a courtroom....

Also, Councilmember Sheedy was really passionate when she spoke- actually impressive.

Both Fong and Sheedy were AMAZING, Sheedy first, with her impassioned speech about *somebody* subverting process and keeping Council out of the communications loop, especially with regard to insisting that the Council as a whole be kept apprised of any investigation into errant practices of the CDD and potential wrong doing ('quid pro quo') rather than relegating the process to KJ's hand-picked audit committee (which could potentially keep it all under the rug), and then Fong, with his AMAZING inquiry of staff about its internal processes and just who might have been responsible for the acts that led to the permit debacle....

All the while KJ was silent -- whether this was because he's just too dumb to ask questions on the matter or because he 'knows something' that might be of interest is unknown at this time.... but it was noticeable....

Btw, Rob Fong, my Council Member, was a member of the Anna Mollander's (of SAVE Sacramento) law firm until fairly recently... He's a 'good guy'....

I agree I thought both were also amazing. I really didn't want to leave but I'd miss my ride at the lightrail. I really wanted to stay and hear Fong. It wasn't a courtroom but he sure gave it the feel of one, again if I were a jury member and he the prosecutor my vote would be to convict (and for me to say that shows I'm impressed- lol) Fong, came out the gate strong. I've seen him at many youth violence campaigns (Stand Together, Yes to Youth....) I agree he's a good guy. He use to work with my cousin MANY MANY years ago and she loves him... Thanks for sharing the info. I wondered if their was a law background in Fong (you can't do what he did and how he did it without training/ experience....-- he was impressive ) Heck after Fong, if I was KJ I would be silent too -- lol (Fong set the bar high)
